Session Week 3

The frenetic pace of a session delayed by
three Special Sessions has continued to
ramp up. The schedule of meetings, one on
top of the other has created a grind and
onslaught of issues that are normally fought
at the end of session to come forward early
and we must remain vigilant in our goal of
keeping law enforcement safe. This week
the FOP opposed language that would have
made the job more dangerous for law
enforcement, managing to stop an
amendment that was filed the evening
before an 8:00 am committee hearing. The
amendment
sponsor
lamented
our
opposition to the amendment, but anyone
reading the legislation would know that law
enforcement would be leery of the
language. The amendment failed and the
bill HB 175 by Representative Baker, passed
out of the House Judiciary Committee clean.
HB 175 is named the "Officer Jason Raynor
Act," and prohibits the use of force to resist
arrest or detention by a known law
enforcement officer, regardless of the
officer's actions during duty. Specifies life
without parole for murdering a law
enforcement
or
correctional
officer,
extending
this
to
cases
involving
manslaughter. The legislation changes the
statutes to specify that resistance against
any officer or legally authorized person
performing official duties is a third-degree
felony.
The Senate companion bill was heard in the
Senate Fiscal Policy Committee and passed
with only 1 no vote. SB 234 by Senator Leek.
